Service terms

These terms apply to every order for a marketing service or a digital product placed through the order form on tossitonline.com. They are written for business customers. This is a translation: if the English and the Dutch version differ, the Dutch version prevails.

1. Who you are dealing with

In these terms "I" and "me" mean Toss it Online (eenmanszaak, a sole proprietorship under Dutch law), the business of Elard Tissot van Patot in Bussum, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 63129124. "You" means the business that places the order.

My full business details are printed below these terms. You can reach me at info@tossitonline.com or +31 6 3472 0079.

These terms apply to the order instead of any purchase terms or other terms of your own.

The apps of Toss it Online and the general use of this website are not covered by these terms. They have their own terms of use.

2. Business customers only

I sell to businesses only: freelancers, sole traders, companies and other organisations that order in the course of their business or profession.

By ordering you declare that you order on behalf of a business, in the course of your business or profession, and that you are allowed to place this order for that business. A company name plus a KvK number or a VAT identification number is required.

I do not sell to consumers. The rights the law gives consumers for online purchases, such as the right to withdraw from the purchase within 14 days, therefore do not apply to these orders.

If I find that an order was placed by a consumer, I refuse or cancel it and refund what was paid.

3. What you order

A package is a one-off order at a fixed price for one website (one domain). It is not a subscription and it does not renew.

What a package contains, including the number of service pages, articles, topics, competitors and images, is described on the page of that package on this website as it read on the day of your order. That description is part of the agreement.

The texts are delivered in Dutch or English, as you chose in the order.

Not included in any package:

  • placing the texts and images on your website
  • carrying out the technical fixes that the audit recommends
  • link building
  • ongoing work after delivery, such as monitoring, updates or reports
  • any guarantee of rankings, traffic, customers or revenue (see section 13)

4. Orders I do not accept

I do not accept topics that amount to medical, legal or financial advice, and I do not accept orders about gambling or adult content.

I also do not produce texts that are unlawful or misleading, or that infringe the rights of others.

If this affects only some of the topics, I replace them with other topics from the content plan. If it affects the whole order, I refuse the order.

I may refuse an order before production starts, for example for the reasons above, because the information you supplied cannot be used, or because I cannot take the order on. I tell you by e-mail and refund the full amount you paid.

5. The information about your business

The work is based on what you fill in when ordering: what you sell, your prices, your customers, your region, what a visitor should do, and the other answers in the order form.

You are responsible for that information being correct, complete and up to date, and for having the right to use it and to let me use it. This includes names, brands, prices, claims about your business and any text you supply.

I do not verify what you tell me about your business. Statements such as your years of experience, your qualifications or your prices are used as you supplied them.

If the information is not enough to do the work, I ask you once by e-mail what I need. The delivery period pauses from my question until I have your complete answer. After that I work with the information I have. Anything that is still missing is marked in the delivery so you can fill it in yourself.

If I have no usable answer within 30 days, I may cancel the order and refund the full amount you paid.

6. Ordering and the agreement

You order by choosing a package on the order page, filling in your business details and the questions about your business, ticking the declarations and clicking "Order and pay". With that click you place an order with an obligation to pay.

Until you click, you can check and change everything you filled in on the order page.

If you pay online, the agreement is formed at the moment I have received your payment. I confirm that to you by e-mail, automatically. If you do not complete the online payment or cancel it, no agreement is formed and you and I owe each other nothing. You can then order again or ask me for a payment link.

If your order is received without online payment (section 8), the agreement is formed at the moment I confirm receipt of your order by e-mail. That confirmation is sent automatically, right after your order.

This arrangement replaces article 6:227c paragraph 2 of the Dutch Civil Code (the confirmation of receipt of an order placed by electronic means).

You can order in Dutch or in English.

I keep your order in my own records; I send you a copy on request. You can save or print these terms from this page. The version that was in force on the day of your order applies to that order. The date of that version is in the e-mail you receive about your order, and I send you the text on request.

7. Prices and VAT

Prices are in euros and exclude VAT. The price is the one shown on the order page at the moment you order. There are no other costs.

The order page shows the price, the VAT and the total before you order.

If VAT turns out to be due after all because information you supplied was incorrect, for example your country, your VAT identification number or your status as a business, you pay that VAT in addition.

How VAT is applied depends on where your business is established:

  • In the Netherlands: Dutch VAT is added. For the packages the rate is 21%.
  • In another EU country, with a valid VAT identification number: I charge no Dutch VAT and the VAT is reverse-charged to you. I check your number in VIES, the European Commission system for VAT numbers. If the number cannot be confirmed when you order, your order is received without online payment and I check the number afterwards. If the number turns out not to be valid, I cannot apply the reverse charge. The order then only goes ahead with Dutch VAT added, or you cancel it free of charge.
  • Outside the EU: I charge no Dutch VAT. You are responsible for any tax that is due in your own country. Your order is received without online payment: I check your business details first and then send you a payment link or an invoice.

8. Payment

You pay online, in advance, through the payment provider Mollie B.V. You enter your payment details on the payment page of Mollie, not on this website. The payment methods available to you are shown there.

In three cases your order is received without online payment: if online payment is technically unavailable at that moment, if your VAT identification number could not be checked straight away (section 7), or if your business is established outside the EU. I then send you a payment link or an invoice by e-mail, to be paid within 14 days. If I have not received the payment by then, the order lapses and you and I owe each other nothing.

If you cancel the online payment yourself or do not complete it, there is no agreement (section 6).

Production starts only after I have received the full payment.

You receive a VAT invoice by e-mail. By ordering you agree to receive invoices electronically. The automatic e-mails about your order and your payment are not an invoice.

9. Delivery

The delivery period is counted in working days from the day I receive your payment. The day of payment itself does not count. Working days are Monday to Friday, except public holidays in the Netherlands.

The period pauses while I wait for your answer to a question about your information (section 5).

I deliver by e-mail to the address in your order, as a download: documents ready to paste into your website system, plus the image files. The order is delivered at the moment I send that e-mail. Download and save the files when you receive them; I do not keep the download available indefinitely.

I plan to deliver within the period and I tell you in advance if I will not make it. If I am late, you can set me a final period of at least 5 working days by e-mail. If I have not delivered by the end of that period, you may cancel the order and I refund the full amount.

Delivery period per package:

  • SEO Start package: 10 working days
  • SEO Growth package: 15 working days

10. Revision

A revision round is one e-mail with one complete list of all the changes you want in the delivered texts and images. I work through that list once and send you the revised files.

A revision covers changes within what was delivered: corrections, wording, tone, emphasis, structure, or replacing an image that does not fit.

A revision does not cover new topics or keywords, extra texts or images, another website, or changes that are needed because your business information changed after ordering or was not supplied. For that you place a new order or ask me for a price.

If I have not received a list within the period below, the delivery counts as accepted.

Errors that are mine and do not come from your information are corrected under section 21, without using your revision round.

Included per package:

  • SEO Start package: revision rounds included: 1, to be requested within 14 days of delivery
  • SEO Growth package: revision rounds included: 1, to be requested within 14 days of delivery

11. How the work is produced

Research and copy are produced with AI, following my fixed process and using Ahrefs data. Every text then goes through a separate check for facts, sources and AI-sounding language. I spot-check every delivery before it is sent.

That separate check is automated as well. I do not read every text in full myself before it is sent.

Each text comes with images that are either generated with AI or made to order as a graphic, such as an infographic or a chart. AI-generated images are illustrations. They do not show your real products, premises or people.

Figures from tools such as Ahrefs, for example search volumes and traffic estimates, are estimates made by that tool.

By ordering you agree to this way of working, including the processing of the information about your business with AI services. The privacy statement at tossitonline.com/privacy/ explains which kinds of services receive which data.

12. You check before you publish

Check every delivered text before you publish it: the facts about your business, your prices, the claims, the statistics and their sources, and the rules that apply in your sector.

You decide what is published. Publishing is your responsibility.

Do not present an image made with AI as a photo of your own work, premises or people. Whether and how you state, when publishing, that text or images were made with AI is your responsibility.

I am not liable for errors that follow from incorrect or incomplete information you supplied, or for damage caused by texts or images that were published without checking.

13. No guarantee of results

I commit to doing the work with care and as described. I do not commit to a result. The packages come without any guarantee of rankings, traffic, customers, enquiries or revenue.

Results depend on things I do not control: your competition, the age and technical state of your website, whether and how you publish the texts, and the way search engines rank pages.

Search engines apply their own policies to content, including content made with the help of AI. I have no influence on those policies and they can change.

Apart from the revision (section 10) and the handling of complaints (section 21) there is no guarantee after delivery.

14. Rights to the delivered work

Once you have paid in full, you may use, edit, translate and publish the delivered texts and images without limit in time or place. You may also let others do this for you, for example your web designer. You do not have to mention me.

I do not deliver the same texts to another customer.

Because the texts and images are produced with AI, I cannot promise that copyright exists in them, or that you can stop others from using similar material.

My methods, process descriptions, prompts, templates and tools remain mine. They are not part of the delivery.

You get no exclusivity on topics, keywords or ideas. Other customers, including businesses in your sector or region, may receive texts on similar topics.

The audit, the competitor analysis and the content plan may contain data from third-party tools. That data is meant for use within your own business.

I do not name you as a customer and do not use your name or logo as a reference without your written permission.

15. Rights of others

Do not ask me for texts that infringe the rights of others, such as copying texts of a competitor, using another party’s brand in a misleading way, or untrue statements about competitors.

You make sure that the material and information you supply does not infringe the rights of others. If a third party makes a claim against me because of information or material you supplied, or because of the way you used or published the delivery, you indemnify me against that claim.

The texts are produced new for your order. With text produced by AI I cannot fully rule out that a passage resembles an existing text. If you notice that, tell me and I replace the passage.

16. Confidentiality

I treat the information in your order as confidential. I use it only to carry out your order. I do not publish it and I do not sell it.

I share it only with the services I need to produce the work and to process your order. The kinds of services are described in the privacy statement at tossitonline.com/privacy/.

Information that is already public, such as the content of your website, is not confidential.

17. Cancelling and refunds

You can cancel an order by e-mail until it has been delivered.

Production starts as soon as I have received your payment. There is therefore no period after your payment in which you can cancel free of charge.

If I cannot deliver the order, you get a full refund.

I pay refunds within 14 days, through the payment method you used or to the bank account you paid from.

What you get back when you cancel:

  • Cancelled before you have paid (an order without online payment, section 8): nothing has been paid yet and production has not started. You and I owe each other nothing.
  • Cancelled after your payment and before delivery: a refund in proportion to the work that has not been done yet. I determine that share reasonably and explain how I arrived at it.
  • After delivery: you can no longer cancel and there is no refund for cancelling. If something is wrong with the delivery, section 21 applies: I correct what is wrong, and if that is not possible, I refund part or all of the amount, in proportion to what is wrong.

18. Digital products

This section applies when I offer a digital product for download, such as a guide in PDF form. Sections 3, 5, 9 and 10 do not apply to digital products.

A digital product is delivered through a download link that is sent by e-mail after I have received your payment. The link works for a limited time, which is stated in that e-mail. If the link has expired, ask me for a new one.

You receive a non-exclusive, non-transferable licence to use the product within your own business. You may not resell it, share it outside your business, publish it or distribute it in any other way, in whole or in part. All rights to the product remain mine.

There is no refund once the download link has been sent. If the file is damaged or cannot be opened, I send you a working file. If I cannot do that, you get a refund.

19. Liability

My liability for damage connected with an order is limited to the amount you paid for that order, excluding VAT.

I am not liable for indirect damage, such as lost profit, lost revenue, lost rankings or traffic, damage to your reputation, or claims of third parties.

I am also not liable for damage that follows from incorrect information you supplied, from publishing without checking (section 12), from decisions of search engines (section 13), or from the way the recommendations in the audit are carried out by you or by others.

These limits do not apply to damage caused by my intent or deliberate recklessness.

Tell me about damage as soon as you discover it, so I can help limit it.

20. Force majeure

I work alone. If I cannot carry out an order because of circumstances beyond my control, the delivery period is extended by the time those circumstances last. Examples are illness or an accident, failures at services I depend on (hosting, e-mail, the payment provider, AI services, data tools), internet or power failures, and government measures.

If this lasts longer than 30 days, you or I may cancel the order by e-mail. I then refund what you paid for the part that was not delivered.

21. Complaints

Send a complaint about a delivery by e-mail to info@tossitonline.com within 14 days of delivery, and describe what is wrong. You can also call +31 6 3472 0079.

I answer as soon as possible and look for a solution with you. I first correct what is wrong. If that is not possible, I refund part or all of the amount, in proportion to what is wrong.

An error of mine that does not come from your information is corrected without using your revision round.

22. Applicable law and court

Dutch law applies to these terms and to every order.

If a dispute arises, I first try to solve it with you. A dispute that you and I cannot solve together is brought before the competent court of the District Court of Midden-Nederland (rechtbank Midden-Nederland) in the Netherlands.

23. Changes to these terms

I may change these terms. The date of the current version is shown at the bottom of this page. The version that was in force on the day of your order continues to apply to that order.

If a provision of these terms turns out to be invalid, the other provisions remain in force.

24. Language and contact

These terms exist in Dutch and in English. If the two versions differ, the Dutch version prevails.
