Terms of Use

These terms apply when you use tossitonline.com or any mobile app published by Toss it Online, operated by Elard Tissot van Patot, based in Bussum, the Netherlands (KvK 63129124). The intent is plain: be straight about what these services offer and what's expected on both sides.

Accepting these terms

By visiting the website or installing an app, you agree to these terms. If you don't agree, please don't use them. If you're using the services on behalf of an organisation, you confirm you're authorised to bind that organisation to these terms.

Eligibility

The services are intended for users aged 13 or older. If you are under the age of majority in your jurisdiction, you may use the services only with the involvement of a parent or guardian.

What the services are

The website is an informational portfolio and contact point — it isn't a logged-in product and doesn't process any transactions.

The apps are mobile applications you download from Apple's App Store. Some are free; some offer optional in-app purchases or subscriptions. Each app's App Store listing describes what it does and what (if anything) is paid.

Purchases and subscriptions

All purchases and subscriptions are processed through Apple's App Store. Apple's standard terms apply, including their refund policy and handling of cancellations.

Subscriptions automatically renew at the end of each period unless auto-renew is turned off at least 24 hours before the end of the current period. Your iTunes Account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package. Subscriptions and auto-renewal can be managed at any time through Settings → [your name] → Subscriptions on your iOS device.

Where free trials are offered, the trial converts to a paid subscription automatically at the end of the trial period unless cancelled in the App Store at least 24 hours before the trial ends. Prices, billing cycles, and any free-trial duration are shown in the App Store at the moment of purchase.

Acceptable use

Please don't:

  • Reverse-engineer, decompile, or attempt to extract source code from the apps (beyond what Dutch and EU law permits)
  • Use the services to break the law, infringe anyone's rights, or harass anyone
  • Resell, redistribute, or attempt to circumvent paywalls or licensing
  • Interfere with the normal operation of the services or the security of other users
  • Send spam or automated traffic to the website

Intellectual property

The names, branding, written copy, source code, design, audio, and imagery of Toss it Online and its apps are owned by Elard Tissot van Patot, except where third-party content is used under licence (which remains owned by its respective rights-holders). You're granted a personal, non-transferable, revocable licence to use the apps for their intended purpose.

Your submissions

When you send a message via the contact form or by email, that content remains yours. By sending it, you grant Toss it Online permission to read, reply, and store it for the purpose of handling your request. Toss it Online won't publish your messages or share them with anyone outside what's needed to respond.

Third-party services

The services rely on a small set of third parties whose own terms apply to your interactions with them:

  • Apple's App Store — for downloads, purchases, and subscription management
  • RevenueCat — used by some paid apps to keep subscription state in sync (see the Privacy page for what's shared)
  • TransIP — the website's hosting provider

Health and veterinary information

Some apps — including NoTick (Tick Checker) — provide general health-related information and self-help tools. They do not provide medical or veterinary advice, diagnosis, or treatment, and are not a substitute for a qualified doctor or veterinarian.

A scan or check is a guide only. A result such as "no obvious tick in this photo" does not mean an area is tick-free — always do a full manual check. If you find a tick, remove it as soon as possible; contact a doctor if you feel unwell or notice a spreading rash after a bite, and contact a vet if your pet seems unwell. In an emergency, contact your local emergency services.

"As is" — no warranty

The services are provided as-is and as-available. Toss it Online works to keep them running well, but cannot guarantee they'll be free of bugs or interruptions, that an alarm will always fire, or that any specific feature will be available indefinitely. Don't rely solely on a Toss it Online app for anything safety-critical (waking up for a flight, taking medication on time, and so on) — set a backup.

Limitation of liability

To the maximum extent allowed by Dutch law, Toss it Online's liability for any loss arising from the services is limited to what you paid for the service in the twelve months before the event giving rise to the claim, or €100, whichever is higher. Toss it Online is not liable for indirect, incidental, consequential, or punitive damages. Nothing in these terms limits liability for damages that cannot be limited by law.

Termination

You can stop using the services at any time by closing the website or uninstalling the app. Toss it Online may suspend or end access to a specific service if these terms are seriously breached, or discontinue any service with reasonable notice in the app's release notes or on this page.

Changes to these terms

If these terms change, the "Last updated" date below changes too. Material changes will be flagged on this page; if you continue using the services afterwards, you accept the updated terms.

Governing law

These terms are governed by Dutch law. Any dispute that cannot be resolved between you and Toss it Online will be heard by the competent court in Amsterdam, the Netherlands. If you're a consumer in the EEA, this doesn't take away your right to also bring proceedings in your country of residence under EU consumer-protection law.
